Terms of Use

Welcome to ARTOGO (hereinafter referred to as “we/our/us”) website (artogo.co). By using the “ARTOGO services“, ”our services“, or “the services”, you agree to comply with all relevant laws, regulations, and the following conditions.

Users are included:

  1. ”Non-member” means users who browse our website but do not register.
  2. ”Member” means users who have registered on our website having an official account ID and password.
  3. ”Manager” means who registered on our website as an account manager.

  1. Changes to Terms of Use

ARTOGO may, from time to time, change these Terms of Use to accurately reflect our services and practices, to promote a safe and secure experience on our products and services, and/or to comply with applicable law. Please check on our site timely as we will not notify users when we update these Terms. Once any updated Terms are in effect, you will be bound by them if you continue to use our Products.

  3. Accounts, Passwords and Security
  4. All users of our website can browse the public content.

    1. We provide access via Facebook/Google login and registered on the website to become our member. You are entirely responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. If there was incomplete or misleading information that caused the violation of these Terms of Use, ARTOGO has the right to terminate our services and will not be liable for any loss or damage arising from your failure to comply with these obligations.
    2. Users should not imitate others' names or use any names that might offend others while applying the account. ARTOGO obtains the right to terminate the account if its name/ID contains any discriminatory words.
    3. The member who created the ARTOGO account is responsible for any activities that occur through the ARTOGO account. The account owner should maintain control over the ARTOGO devices that are used to access the services and not reveal the password or details associated with the account to anyone. If your account is hacked by others illegally, you should notify us immediately and we will endeavor to provide aid.
    4. ARTOGO is unable to predict and prevent the risks of law, technique, and others including but not limited to irresistible, virus, hacker attacks, system unstable, defective services from the third parties, government behavior that might cause service interruption, data loss, or other damages. Therefore, we are not responsible for above situations.

  5. Protection of Intellectual Property
  6. The software, programs, and design on our website including without limitation to, information, data, graphics, files, website framework and designs, or other materials, belong to ARTOGO or its right holders embodied in its Intellectual Property, including patents, trademarks, and copyrights. Anyone should not modify, remake, disseminate, publish, or do reverse engineering. Use of quotation or reference without the prior written consent of ARTOGO or its right holders may constitute infringement, and you should take on the compensation (including without limitation to legal expenses).

  7. Transaction Behavior
    1. Besides these Terms of Use, information of product/service purchase and order process including transaction conditions are part of the terms.
    2. As you follow the instructions, conditions, and process to finish the order on our website, which means you understand and agree to comply with these Terms of Use and transaction regulations prior to your order.
    3. System will send the notification automatically to your provided email as you finished the purchase of exhibition/work/services. ARTOGO will notify you the order cancellation if it is out-of-stock or any reason.
    4. ARTOGO obtain the right to decline the transactions, terminate or on hold of a member account under certain circumstances that members cancel, return the order intentionally or any inappropriate behavior caused our damages or difficulties.
    5. You understand and agree that ARTOGO will endeavor but not ensure all the related content on the website is completed, accurate, and timely. The maximum order amount and conditions of relevant products will be recorded on order and purchase process pages. If there is any mistake of specification/image/description, information should be subject to exhibition provider (curator). If the price on the site is incorrect:

      ※ if the marked price is higher than the correct price, we will charge you the lower and correct price;

      ※ if the marked price is lower than the correct price, we reserve the right to reject the order.

    6. The quality, warranties, and after-sale of your product/service are subject to each product/service provider, agent, or distributor. Our site is committed to help you solve the questions or disputes due to online shopping.
    7. The shipping fee of the exhibition, work, or services you purchase is regulated on the sale page and the order process.
    8. You understand and agree that all the online shopping and transaction affairs will be recorded by digital document automatically by our system. You are able to log in and check the relevant transaction data and notify our site at once if there is incorrect.
    9. To purchase any digital content you must provide the personal data including credit card information, which will be direct to and in charge by our collaborated third parties. To ensure the membership data and transaction information is correct and protect the data security, our site will not acquire the information.

  8. Cancellation, Return and Refund
    1. Refund
      1. According to the Consumer Protection Act, consumers of distance sales or door-to-door sales may return the goods or rescind the contract in writing within 7 days upon receipt of goods or services without stating the reasons or be responsible for any expenses or costs, except in the case of distance sales with reasonable matters via the refund page.
      2. Notice of Exhibition Ticket Refund:
        1. Only the tickets bought and did not be used within 7 days
      3. Notice of Product Return/Refund:
        1. Please contact ARTOGO if you want to exchange the item.
        2. Please ensure that the item you're returning is well-packaged as original or repackaged with all the attachments and freebies that were included when you received it.
        3. Please send out the item within 3 days after your return application was accepted. Otherwise, we are unable to do the return process.
        4. Extra shipping fee will be charged to our customers if the returned item is incomplete or lacks of accessories that we need to arrange the logistic company again.
        5. We cannot provide full refund if it lacks of items or damaged during returning.
      4. There are items, however, that are ineligible for return, including:
        1. The bought tickets or items are over 7 days.
        2. Customers damage the package or remove the tags/stickers not because of checking the product.
        3. Consumables that are unpacked.
        4. Items are no faults.
        5. Particular products that have validity period are non-returnable.
      5. Refund policy for software subscription:
        1. If the content has not yet been made public or launched, you may cancel the ARTOGO subscription service by emailing service@artogo.tw. If you terminate the subscription before the end of the ARTOGO subscription period, ARTOGO will refund the prepaid fees in proportion to the subscription period after the termination of the subscription.
        2. If the content has already been made public or launched, no refund can be issued.

        then send you an email as confirmation.

        Please read the terms of refund for the arrangement.

    3. Additional Information
      1. Please keep the tracking number for status query. It will cause inconvenience if you missed the return form.
      2. All fee will be paid by ARTOGO if you choose the return way of “Cash on Delivery”. Our site will not pay for any fee for the rest of delivery ways.
      3. Please send out the item within 3 days after your return application was accepted. Otherwise, we are unable to do the return process.

  9. Content Rights
  10. All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, "Content"), including but not limited to the design, structure, selection, coordination, expression, "look and feel" and arrangement of such Content, contained on the Site is owned, controlled or licensed by or to ARTOGO, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws. ARTOGO has the right to use, edit, promote the Content for marketing as its related to our services.

  11. System Consultation and Maintenance
    1. ARTOGO provides you online system use consultation and maintenance service in operation of the site. Our site is not liable to the accuracy, completion, security, reliability, suitability, interruption of the data you connected. The quality of the service may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. You are unable to claim any compensation or right due to internet connection or any environmental reasons from our site.
    2. ARTOGO website will regularly migrate, replace, or maintain for better service that might suspend or terminate the service. We will notify on the site 72 hours before such maintenance except accidental or irresistible reasons. ARTOGO will provide extension or repayment of the exhibition impacted by such maintenance.
    3. ARTOGO is responsible for service related system maintenance. Please contact us if there is system unavailable or failure.

  12. Service Modification
  13. ARTOGO reserves the right, in its sole discretion and without prior notice, temporarily or permanently modify or terminate the service (or any part of it) on the site. Users consent to backup data attached on the site anytime to prevent the data loss, and our site do not take the responsibility of content and related loss.

  14. Service Termination
  15. Users agree that ARTOGO may, in its sole discretion and without prior notice, terminate your access to the Site and/or block your future access to the Site if we determine that you have violated these Terms of Use or other agreements or guidelines which may be associated with your use of the Site. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to ARTOGO, for which monetary damages would be inadequate, and you consent to ARTOGO obtaining any injunctive or equitable relief that ARTOGO deems necessary or appropriate in such circumstances. Users are well noted and agree that ARTOGO will interrupt, terminate, cancel, or delete the services and accounts with prior notification when we found any violation of these Terms of Use.

  16. Disclaimers
    1. The site and its content are delivered on an “As-Is” and “As-Available” bases. All information provided on the site is subject to change without notice. ARTOGO disclaims all warranties, express or implied, including any warranties of accuracy, non-infringement, merchantability and fitness for a particular purpose.
    2. ARTOGO does not promise the site will be safe, stable, error-free or uninterrupted. You are aware and willing to undertake any potential risks and damages while using our services after reading these Terms of Use.
    3. Your consent to use the service is based on your willing and you assume total responsibility for your use of the site, including downloading digital content, data, images, and any linked sites that might cause your system damages or data loss.
    4. ARTOGO cannot ensure that any files, emails, or other data you downloaded or received from the site will be free of viruses or contamination or destructive features. ARTOGO does not promise that the site or any content, service or features of the site will be error-free or uninterrupted, or that any defects will be corrected, or that your use of the site will provide specific results either. We are not liable to the compensation.
    5. ARTOGO cannot ensure any inappropriate or unpleasant content you might receive from the site, and we do not take the liability of this. However, we are willing to understand and reflect your complaint to the content provider or take appropriate measures.
    6. The reasons below cause the loss of benefits, business credit, data or any visible and invisible damage, our site do not take on any direct, indirect, associated, derivative, or penal compensation:
      1. This website is available or unavailable.
      2. Any product, data, service purchased or obtained by this site.
      3. User information is used or modified without authorization.
      4. Other affairs related to our site.
    7. ARTOGO has the right but no obligation to improve or correct any omission or mistake.

  17. Indemnity
    1. You agree to indemnify and hold ARTOGO harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms of Use, your improper use of ARTOGO services or your breach of any law or the rights of a third party.
    2. The ARTOGO service and any content accessed through the service are for your personal and non-commercial use only and may not be shared with individuals. During your ARTOGO membership we grant you a limited, non-exclusive, non-transferable right to access the ARTOGO service and content. Except for the foregoing, no right, title or interest shall be transferred to you. You agree not to use the service for public performances. We reserve the right to terminate your service and claim for 1,000 times of the ticket price as compensation if we found any violation of above situation.
    3. ARTOGO disclaims any and all liability for the acts, omissions and conduct of any third parties in connected with or related to your use of the site and/or any ARTOGO services.
    4. Users understand and agree the disclaimers and indemnification in these Terms of Use are reasonable part of the bargain between the parties. The restriction is the important base for our site existence and feasible on economy.
    5. You agree to indemnify and hold ARTOGO harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms of Use, your improper use of ARTOGO services or your breach of any law or the rights of a third party.

  18. Validity of Clauses
  19. You agree that ARTOGO may, at its sole discretion, change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes as ARTOGO announced on the site. Your continued use of the site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Use, ARTOGO grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the site.

  20. Governing Law and Jurisdiction Clause

You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by the laws of Republic of China (Taiwan) without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in courts in Taipei City, Taiwan and waive any objection to such jurisdiction or venue.
